As we approach the end of 2022, we will be assessing the many trends that we have seen this year for both Cayman Islands and British Virgin Islands (BVI) investment funds including (i) the huge increase in the number of investment funds investing in Web 3.0 technology and infrastructure, (ii) the continuing growth of investment funds in the digital asset space generally, (iii) the continuing growth of hybrid funds and multi-strategy funds utilizing the SPC structure, (iv) the competition for the domicile of investment funds from mid-shore jurisdictions such as Hong Kong and Singapore to the traditional dominance of offshore jurisdictions such as Cayman Islands and the BVI as preferred jurisdictions, (v) regulatory and compliance developments for investment funds in the Cayman Islands and the BVI, and (vi) the impact of the collapse of crypto exchange, FTX. Will any of these trends continue into 2023? If so, which ones and how will they impact offshore investment funds in the Cayman Islands and the BVI?

Elizabeth joined Loeb Smith’s Corporate Group from KPMG Legal Group in the UK having worked for KPMG in both the U.K. and Milan, Italy. Previously to her career at KPMG, Elizabeth was an attorney at DLA Piper in the UK. She advises on the formation and launch of Cayman Islands mutual funds and private equity funds, especially for our clients in mainland China. Kenny also advises on a wide range of general corporate matters relating to mergers and acquisitions, cross border joint venture transactions, acquisition and disposal of shares and business assets, re-domiciliation of corporate vehicles from other jurisdictions to the Cayman Islands, shareholders’ rights issues, and fiduciary duty issues for directors of companies and general partners of limited partnerships.
